I mean, it's the same thing as the new three wheeled cars they have out which don't qualify as a car, but fall under I think the motorcycle laws, thereby bypassing the emissions standards and crash test regulations. This type of stuff is literally the free market finding a way to provide a product to fill a market need, regardless of the hurdles put into place. That's what's so awesome about markets, they find a way to exist no matter what.
