Imagine trading in your 2011 Camaro SS and selling your 1969 Camaro SS to buy a brand new ZL1 Camaro. These cars are borderline race cars with almost 600HP and about 550 lb.-ft of torque. Not for the weak of heart…

The ZL1 is your baby and you treat it with the best care you can. The car only gets driven about 11,000 miles in the two years you own it. But then you take the car into the dealer for some warranty work for an issue with the paint.

At 9:00AM Monday morning the dealer calls you saying your car has been totaled. What would you do in that situation?

That’s exactly what happened to one member over on Camaro5. According to his story, the car was dropped off for some paint issues. On a Sunday an employee of the dealership came in and took the car for a joyride. While out testing the limits of the car, the employee lost control of the car and wiped out a telephone pole.

As of right now the whole case is being hashed out by the owners and dealers insurance companies. The owner is asking for a brand new ZL1 and it looks like the dealer doesn’t want to do that. There is a lot of talk on the forum as to what is right and wrong. Even the local media has also picked up the story and has been doing their investigations.

lol at the dealer not wanting to replace it. I am uncertain how they think they are not liable.

From reading the excerpt above, it sounds like the employee stole the car after hours, and while it sucks, the dealer isn't responsible. The only way the dealer would be responsible would be if they knew and or encouraged this type of behavior. And even then its sketchy as to whether they should give him a new car or just give him the book value of the wrecked car.

the only counter argument I could see though, it's still the dealerships responsibility to secure the vehicle, what if it was just some joe off the street who took it for a joy ride, wouldn't it still be back on the dealer?

It would be on the Dealer's insurance, but still only for book value.

ah, I would imagine the amount of negative publicity this generates and lost revenue, I would just replace it, I know I would never take my car there

As WESH 2's Dan Billow reported Tuesday, a man whose car was wrecked by a repair shop employee may be out of luck. Wrecking the car wasn't a criminal offense, and a lawsuit may not do you much good.
