my MIL asked me yesterday to call the local PD down there like my lawyer had recommended to see what they say. I told them what had happened, they recommended trying to work it out or report them as stolen. Technically he did steal them, they were part of dad's estate and since there was no will, the lawyer that handled the estate had all the kids sign a agreement that everything of dad's was to go to mom.
They said they would be willing to accompany me if I flew down there to make the exchange. I left my BIL a message relaying what his local PD had said, he called his sister and said he would release them. I'm not going to fly, trying to work out the FFL transfer now

so his wife texted me and wanted to know how we were going to transfer last Sunday. I told her all she had to do was to drop the guns off to the dealer she had given me the address to, I would have my local dealer contact them to exchange ffl info. She said she had to work on mon and tues, but could drop them off on wed. She wanted to know if that was alright.
I said that would be fine.
She replied her husband also wanted 1000 dollars back from his mom he had given her to replace the basement windows. I bit my tounge and replied, well if you can produce a cancelled check within 2 months that mom had the windows replaced, I will reimburse you for it.
So wed came and I stopped at my local dealer and he called down to their dealer. The guy had no clue what we were talking about. Super.
So I told my dealer I would give it till 5 pm, if nothing was heard from the dealer, I would contact my SIL
Well my brother was up and I got sidetracked before I realized it was 7pm, so I sent her a text asking if she had dropped off the guns.
She texted me back, no she wasn't sure where we were at with that, I replied I had set everything up, had talked to the dealer down there, she just needed to drop them off.
Ok she replied, but her husband was still asking about the 1000 dollars and wanted a notarized letter from his mother stating the guns were his and he wouldn't have to deal with anyone laying claim to them anymore.
So I called my mother in law and informed her of the conversation, and she flipped. Kyle you gave me the money for the windows for x-mas, he didn't give me anything.
I know I replied.
And I'm not giving him a letter,

So I called her back and told her mom did not want me to give them the 1000 dollars and I was in no position to produce a letter. As far as I was concerned, I was shipping them the SKS he said was his, plus a 1000 round case of 7.62x39 that is worth about 600 dollars, plus paying all shipping and transfer fees. As far as I was concerned, I was going above and beyond what was required. I reiterated if we could not come to a agreement, our only option told to me by my lawyer, their local pd and the lawyer who handled dad's estate was to report them stolen. I also mentioned again, since the lawyer who handled dad's estate had a letter from them signed stating everything of dad's went to mom, technically they were stolen and they crossed state lines. What would you like to do, I asked?
She said the guns would be dropped off the next morning.
So thursday morning I got a text from her and call from my dealer the guns had been dropped off, but the dealer would not ship them till he received payment.
So I called him and told him who I was and I wanted to pay the shipping and transfer fees.
He said that was fine, but he only accepted money orders, they don't take credit cards over the phone. Also they only ship on mondays.
So I asked how much the shipping and transfer was, he said 125 dollars and it take 7-10 days to get to us.
I asked how much for next day air?
He said he could only give me a rough estimate, but it would be several hundred dollars.
I said give me the rough estimate.
He looked online and said it would be about 250, I asked if that included all the transfers, he said yes, except for theirs for the sks, I said so 280 then for everything.
Yes, he said.
I replied, so say I next day aired you a money order for 350, that should cover everything. If it is more than the cost, I want you to keep the extra for helping us with this as profit, if it's not enough, will you still ship the guns and just bill me for the difference?
After a moments thought he said he could do that.
So I mailed out the money order on thursday, it was suppose to be there by 3 pm saturday, it was to late to next day it I guess.
So I have been checking the tracking and as of sunday it still wasn't there, so I called him and asked if he had received it.
No he said, he has been so busy on saturday, he hadn't been able to go check his post office box, he would just grab it on monday when he went monday to ship the guns.
Well there's a problem with that I replied, monday is columbus day.
Oh crap he said.
So I asked if I was going to have to wait till next monday for the guns to be shipped.
No he said, that wasn't my fault, he would go tuesday and pick up the money order and ship the guns.
I checked the tracking number this morning, it said it was ready for pickup.
I got a phone call around 3 pm saying he shipped the guns and gave me a tracking number.
Hopefully the guns will be here tomorrow, thursday at the latest. I will inspect them and make sure he wasn't being vindictive and damaged them in any way, as long as everything checks out, I will authorize my shop to ship the sks and ammo to their dealer.
I will take a picture of them to show you guys when they get here, the ar-15 will go into my gun safe, the thomspon and the henry we will take down to my mother in laws at christmas and transfer them into her name and will get mounted above the fireplace. The thompson was the last gun she bought dad and the henry was the last gun I bought him. They will be back in their rightful home.

costly..... but whatever it takes to get the job done i suppose. k, you might look into other options with the firearms that are going back into your mom in laws home...if she agrees.
thinking ahead to the future never hurt anyone. if there is no legal will in place then it may behoove all parties to consider future options. also, changes in mental status occur as well a sudden medical events that can complicate legal decision making.

agreed Moro, that is something we are working through now, mom is of sound mind and body and she just modified her will. But she is pissed, she wants to report all the fire arms as stolen for several reasons. We told her we would support her in any choice she makes, but she needs to realize, if she reports them stolen, there is a very good chance her son will go to prison for a long time. She said she will think about it and let me know. If she tells me she is done with it, I will call my BIL and SIL and fill them in on some information that my FIL made me privy to that will make sure they never contact anyone in this family again. So we shall see.
But, the firearms came in today
the bushmaster AR-15 25th anniversary edition, 1 of 1500 made I bought this from a friend that was going through a divorce, I told him if he ever wanted it back, it was his, so it is going back in the gun safe until that day comes
henry .22 lever action. It was the last fire arm I had bought for my father in law, he always wanted one
and the thompson .45, also known as the tommy gun, weapon of choice of the gangsters in the beginning of the last century. He was visiting about 10 years ago and we saw it at a shop in Bangor, he kept talking about it, even when he went back home. He talked about it so much, my MIL called me and said, what gun is dad talking about? I told her, she said to go buy it, so I did.
the sks and ammo will be shipped in the morning, I stripped and broke down all the firearms, checked the barrels, etc. Everything looked good.
