Looking at Wikipedia, it looks like the longest time has been 125 days with Brandeis in 1916.  And there have been other Judges appointed during election years.  I'm a republican, but the GOP is looking really bad on this imo.  At least pretend to play ball with Obama.  Or try to negotiate with him.  But to say you'll block it for a whole year?  That's just childish imo.

Eh, I mean it's not going to matter really who gets put in there. There has been a (relatively) big surge in states simply ignoring bad federal law regardless of supreme court opinions. look at every medical marijuana state, as well as Washington and Colorado. States like Kansas and I think Montana have not only said that they won't enforce a weapons ban, but will arrest any federal agent who tries to come into the state to enforce one. We're getting to a place of states taking the power back from the federal government, and it's working because ultimately that's where the power lies.

...if the Fed thinks that things are being pushed to much they have been know to threaten cut backs to state aid/programs until the state complies.,,that's some serious leverage.

And that's the whole point. They don't physically have the manpower (or the constitutional authority) to go into a state and enforce some of the laws they pass, they primarily fulfill this function with the cooperation of local authorities. The states being addicted to federal money is the biggest issue. The fact that the fed gov has had the states on a heroin drip of free money for so long makes it hard to get away from. It's also going to make it hurt that much worse if we have a real currency crisis.
